The broadside attack against Title VII and disparate impact has nothing to do with the Constitution and everything to do with disliking anti-discrimination laws in the workplace.
Even in the Title VII context, I am befuddled about this. First, Title VII treats all traits equally. It does not only apply to racial minorities, women, or LGBTQ people, etc. And when an employer undertakes a disparate impact remedy, there's doctrine now that restrains proactive decision-making.
This is especially true of the first-time Atlanta visitors.
