That was my immediate reaction when I read this. The DOJ knows that this legal opinion violates Olmstead. They are trying to bait Democratic state attorneys general or the ACLU to file a lawsuit so this goes to the Supreme Court and therefore weaken or kill Olmstead.

This week, the Department of Education announced that the Department of Justice would handle civil rights. But the Department of Justice announced a legal opinion saying that states do not need to provide community-based care for people with disabilities.

The irony, of course, is that Kennedy's uncle, the late Sen. Ted Kennedy, wrote the Americans with Disabilities Act and helped craft multiple versions of the Individuals with Disabilities Education Act, while his aunt Eunice Kennedy Shriver started the Special Olympics.
