That was my immediate reaction when I read this. The DOJ knows that this legal opinion violates Olmstead. They are trying to bait Democratic state attorneys general or the ACLU to file a lawsuit so this goes to the Supreme Court and therefore weaken or kill Olmstead.

Oh my god they’re trying to get SCOTUS to narrow or overturn Olmstead (because this sucks so much that there surely will be a lawsuit saying this defies Olmstead). This is fucking chilling.
This week, the Department of Education announced that the Department of Justice would handle civil rights. But the Department of Justice announced a legal opinion saying that states do not need to provide community-based care for people with disabilities.
