That was my immediate reaction when I read this. The DOJ knows that this legal opinion violates Olmstead. They are trying to bait Democratic state attorneys general or the ACLU to file a lawsuit so this goes to the Supreme Court and therefore weaken or kill Olmstead.

Almost all of the Black touchstones uplifted in the US were avowed socialists and Communists and I always find this so funny. So many people including some Black people elide this fact.
