Unauthorized derivatives are not copyrightable even without AI gen.
If you use someone else's work in some way, lets say as an input to make a "transformative" derivative then even without AI gen the resulting derivative could not be protected.
e.g. 17 USC §103(a).

Nope. That would be fraud.
Profit how? If the output is worthless and can be taken by others (who don't even have to acquire AI Gen software to take the output from those that do use the software) then there is no actual viable business model sustained by profit (such as through licensing of outputs). It's all a scam.
Even games that are not made with AI Assets lack full protections.

Ok - but the AI Gen outputs themselves would be public domain and commercially worthless. AI Gen is a machine that requires valuable property (worth billions) to actually work - and then produces worthless unlicensable stuff that anyone can take for free.
It's a stupid tech that produces fools gold.
