Kagan: "Consider a hypothetical law that is the mirror image of Colorado's. Instead of barring talk therapy designed to change a minor’s sexual orientation/gender identity, this law bars therapy affirming those things." Adds when state suppresses one side, "constitutional issue is straightforward"
This decision applies only to talk therapy, not forms of "conversion therapy" that involve physical interventions (which are really abuse). It does not strike down Colorado's law on its face. Actually, it does not invalidate anything—it just holds that this kind of law is subject to strict scrutiny.
This is called “strategic defeat.” You have ended up in a worse position than before you began, with your adversary, while battered, emerging in a stronger position than before.
