There was once judicial precedent and Republican SCOTUS decided it no longer mattered and gave birth to this. The 5th Circuit was always bad, but now they think they can just keep hammering at prior SCOTUS decisions until the Republicans agree with them.

The 5th Circuit refuses to take a hint and rules that the federal horse racing commission is unconstitutional, even though SCOTUS already tossed out that decision once. Now it'll have to do so again next term I guess. www.ca5.uscourts.gov/opinions/pub...
