This worries me a lot, every campaign worth its salt has a “escalation strategy” of some kind, and surely a core principle of justice is that you should be judged on what you have done, not what you might do.

Shabana Mahmood's appeal is allowed. The Court of Appeal finds the decision to proscribe Palestine Action was lawful. Key is what the Court of Appeal describes as its "pattern of escalatory behaviour" - i.e. what it might do in the future.
