This is painful to watch. Appellant included numerous fictitious cites and is rightfully criticized by the panel for it. But the criticism doesn't end there--neither appellee apparently reviewed Appellant's brief closely enough to catch the cites, and that's also unacceptable.
1st of all, yikes
2nd, gopuff applied to register GOODNUT as a trademark but appears to be using GOOD NUT. so is the brand 1 word or 2? (& brady's or gopuff's?)
3rd, @uspto thinks there's a likelihood of confusion w/ COCONUT GOODNESS, also for coconut water, so we shall see 👀
