ICE has been citing a May 2025 memo to justify arrests in immigration courts. An agency lawyer told prosecutors yesterday that it doesn’t include such authorization.
This means ICE has not provided any legal justification for the mass arrests at EOIR courts in NY or other states.
Alerting the court, AUSA Tomoko Onozawa wrote that the error was not due to a lack of diligence on prosecutors’ part.
“The undersigned were specifically informed by ICE that the 2025 ICE Guidance applied to immigration courthouse arrests.”
