In January 2025, the Fifth Circuit Court of Appeals sent the #DACA case back to Judge Hanen in Texas with two instructions:
→ 1. Narrow his ruling so it only applies to Texas.
→ 2. Consider whether, in Texas, work permits should be separated from deportation protection.
Now we wait for Judge Hanen’s next decision.

Sept 29 – first round of briefs filed
Oct 20 – responses due
Oct 27 – replies to responses
This week, the first round of briefs was filed. But the status quo remains the same: DACA renewals continue and first-time applications are received but not processed.
In July 2025, Judge Hanen asked all parties in the case to submit written briefs answering questions like: Should other states also have to show harm from #DACA? And how would a Texas-only change work in practice?
