Nitrogen update: Judge Marks in Montgomery denies the State of Alabama’s application to stay her permanent injunction against nitrogen gas while the state appeals. The equities are clearly against the state.
Nitrogen gas update: the Eleventh Circuit in Atlanta has affirmed that nitrogen gas asphyxiation is an unconstitutional method of execution, by a vote of two to one, and denied any stay of the permanent injunction. So nitrogen gas is unconstitutional as per the Eleventh Circuit panel.
