Need info? Go straight to the official site and log in.
If you don’t know what your email disclaimer says, it’s time to check.
And possibly trim.
Because it probably (definitely) shouldn’t be longer than most of your emails. (3/3)
The Fifth Circuit made a big call in the Intuit vs. FTC case (centered on whether the "free" ads were misleading).
The finding? The FTC can’t use its own in-house court for the claim, which could mean more such cases end up in federal court going forward. 👇

Some reminders:
You can’t create privilege by typing “privileged & confidential.”
A unilateral disclaimer doesn’t create confidentiality.

It’s been more than 10 yrs since IRS told folks to drop those long Circ 230 disclaimers. And yet, they persist.
Worse? Disclaimers are getting longer.
CVS receipt-level long.
In 2015, the longest I saw was 412 words. Today, I saw one that was 1,513 words.
On an email that was under 200 words. (1/3)
