4. A little known detail about the Miranda decision was that the opinion was largely drafted by Ken Ziffren, hired by Earl Warren as a law clerk when he was fresh out of the UCLA School of Law. Ken's father, Paul Ziffren, was an attorney of great renowned, with many show business clients.
3. And that is why the right wing has been attacking Miranda for 6 decades, whittling its reach back at every opportunity. Not because of "loyalty to the Constitutional text" or some such risible myth, but because they don't like having their cops being told what to do.
2. ....and concludes with "It is obvious that such an interrogation environment is created for no purpose other than to subjugate the individual to the will of the examiner." Miranda wasn't written to give criminals a pass, it was written to reign the cops in.
