Not surprising. The plaintiffs' case has many, many problems. Judge Pitts might simply deny the TRO on the ground that Stanford isn't a state actor. Easiest way out.

Judge Pitts asked why DOJ wasn't sued, why not in ND Texas, what would happen w conflicting orders. The lawyer for the patients—Caleb Hayes-Deats from Abbe Lowell's new firm—did not do a great job of answering things.
