Given the overlapping charges and evidence, joining the cases makes sense, but Duterte’s health is also a factor to be weighed. Parallel trials may yet occur.
If the answer is no, the Philippines Situation - and the case against Duterte - effectively comes to an end.
If transferred to The Hague, a key issue for the Court to decide will be the possible joining of the Duterte case with the new case (assuming charges are confirmed).
But the AC may still agree with the ultimate conclusion. Either way, interesting questions of statutory interpretation and jurisdiction will be resolved today.
This could significantly delay the start of Duterte’s trial, which does not yet have a date.
