NEW: A federal appeals court has rightly affirmed that the Trump admin's policy of detaining immigrants without any process is unlawful. The mandatory detention of millions of noncitizens - many of whom have lived here for decades - defies the Constitution and basic human decency.

The decision marks a split at the appeals court level, setting up the possibility for the issue to reach the Supreme Court.
