Drawing on a year+ of fieldwork in Lebanon's juvenile courts — interviews with judges & court staff, courtroom observation, analysis of court documents — Lama examines how judges exercise discretion in child protection & delinquency cases.
when judges act "in the child's best interests," does that flexibility protect children — or enable deeper surveillance, moralised intervention & the erosion of fair trial rights?
It is a paper that will be of particular interest to children's rights scholars, comparative legal academics, those studying how multiple factors (religion, morality, psychology) shape judicial reasoning, and anyone working on juvenile justice and socio-legal method.
Her argument: this discretion is a double-edged sword. Judges take on a hybrid role — mentor, disciplinarian, moral guide — drawing on religious, psychological & cultural frameworks alongside (or instead of) formal legal reasoning.
