I am *very* excited about this paper! And especially glad to see someone tackling Justice Alito’s baffling claim in Matal v. Tam that “giving offense is a viewpoint”

Even if Stephen Miller wanted to, he could not stop rank-and-file CBP and ICE agents from using their discretion to exclude Black and Brown people. Conversely, even if he could stop them from harassing diplomatically important people, he wouldn’t.
I think many FIFA officials must’ve been assuming that the administration would be coordinated and disciplined enough to refrain from harassing *some* foreign visitors—the special, important ones. This was a serious mistake.
