Fine. If two units attack eachother at least one of them must hit the other. If one is attacking while the other is retreating missing is on the table since it gives the defensive party a chance to advance the game without landing a hit.
Point being is that each action must cause a reaction. Something needs to move forward, and there are more ways of doing that than a dagger getting into someone's torso.
While im here let me dunk on 5e for a sec and say 70% of the issue is the binary nature of hit points. Unless that hit drops you to 0, it did pretty mich nothing to advance the game. A player with 36 HP and a player with 28 HP feels exactly the same.
