I think it’s important to recognise that is legit for lawyers to have political ideas and support causes, and that that isn’t in itself a sign that they’re not independent minded. On the contrary it’s often one way in which independent mindedness manifests itself in my view.
Professor Dickson seems convinced that the CJEU would not strike down a domestic law specifically for the purposes for Northern Ireland. I'm less so. This is what it has the jurisdiction to determine if a reference reaches it, simply by its interpretative powers? 30/
