Using secondary legislation to implement stuff like this makes me uncomfortable. Secondary legislation *should* be used for technical details and tweaks like increasing monetary limits, not substantive policy implementation!

Obviously we have yet to see the precise details of the government’s plans, but in terms of what legislative authority they have to implement some of the measures being reported, this would seem to be the relevant bit of the Children’s Wellbeing and Schools Act, which was passed earlier this year
